Client: RHA Properties v Menlo Capital Group LLC: Mr. DiDonato was retained by Shartsis Friese LLP to provided expert testimony and written declarations regarding the standard of care to retrofit an aluminum electrical system for a 401-unit apartment building located in Richmond CA. On 7-7-17 Mr. DiDonato provided his uncontested testimony to the Honorable Ronald M. Sabraw; Superior Court of the State of California, County of Contra Costa, JAMS facility located at 1255 Treat Blvd, Walnut Creek.  Ongoing.

 

Client: Molinaro Way located on Stanley Street, Pleasanton, CA approximately one block east from Main Street is a 13 unit subdivision consisting of Spanish Revival and Andalusian 2-story handcrafted single family homes. Mr. DiDonato managed all aspects of the entitlement process and received the City Council’s final approval in September 2011.

Estimated Cost: $7 million.

 

Baseline Construction Services: Clients, Projects & Responsibilities

 

Client: Warmington Homes California

Project: Bayport Alameda located at the former naval base in Alameda is a master planned community development on 85-acres that included 485 homes, 11-acre park, elementary school, off site capital improvements and a upgraded storm drain facility that emptied into the San Francisco bay. Mr. DiDonato’s responsibilities included the creation and maintenance of the Master Project Schedule which consisted of over 2000 activities that coordinated the entitlements, construction documents, permits, on and offsite improvements, site remediation, public agencies, home construction and sales.

Total project cost: $150 million.

 

Client: Malcolm Properties Inc.

Project: 631 Folsom, SF: Mr. DiDonato was retained by Malcolm Properties as the scheduling consultant for BLU, a 21 story, $130M high rise luxury condominium project located at 631 Folsom Street in San Francisco, CA. The owner was a joint venture consisting of Malcolm Properties, Inc and Lennar Urban. Mr. DiDonato was retained to analyze the general contractor’s claims for extended general conditions costs arising from alleged Owner caused delays. The general contract between the parties contained a clause which granted ownership of float durations to the Owner. Using this clause the majority of the general contractor’s claims were identified as non critical float and no entitlement to additional time was permitted. A detailed analysis of each general contractor weekly update schedule was required to track and compare the overall project impact to the contractor’s baseline schedule. The final scheduling analysis resulted in not only a denial of the general contractor’s claim for additional general conditions costs, but a $2.050M levy of liquidated damages against the general contractor. Due to the strength of the scheduling analysis, no litigation was required by the Owner in settling the scheduling claims or in obtaining the liquidated damages payment from the general contractor.

 

Client: Martin Land Company

Project: Jeffrey Way located in Brentwood California is a 14-acre development consisting of 240 condominiums and a 6-acre flex use business park. Mr. DiDonato provide pre-construction analysis, budgets, project schedule, permit & fee estimates, coordination of City agencies, design evaluations, contract management and general construction council. The project was shelved in 2007. Estimated cost: $95 million.

 

Client: Martin Land Company

Project: Lone Tree Center located at 6730 Lone Tree Way in Brentwood California is a 20-acre, 178,000 SF retail development that is home to WinCo Foods, Kragen Auto Supply, Straw Hat Pizza, Hollywood Video, Golf USA, Mosquito Lounge Restaurant, Al’s Bakery, Hightech Nails, New Life Cleaners, Fantastic Sam’s, Dollar Store, El Taco, Postal Annex, Realty World, Dexter Dogs and First Cellular. Mr. DiDonato’s responsibilities included the pre-construction and construction management. The project was finished in June of 2005.

Cost:  $27 million.

 

Client: Martin Land Company

Project: Hayward Commons is a 1.17 Acre, 15 home development located at 26965 Hayward Boulevard in the Hayward Hills Mr. DiDonato provided the initial construction analysis, scheduling and cash flow analysis for the project.

Cost: $5.2 million.

 

Client: Pinn Brothers

Project: Union City Commercial located at the corner of Bettencourt Way and Union City Boulevard in Union City is a 2-acre mixed use development consisting of 20,000 SF of retail and 22-condominmums. Mr. DiDonato’s services included the removal of nine easements impacting the property, coordination of public works, PG&E and the removal of a private nitrogen gas line, creation of the project schedule and consultant coordination.

Cost: 6.5 million.

 

Client: Malcolm Properties Inc.

Project: 149 2nd Street located in San Francisco is a 4-story, 26,000 SF mixed use office / retail renovation project with seismic improvements. Mr. DiDonato’s services included the initial analysis of the construction documents and creation of the project schedule. This project was completed in 2004.Cost: $5.5 million.
